Default Problem nurses stay on the job as patients suffer

Nurse Owen Jay Murphy Jr. twisted the jaw of one patient until he screamed.

He picked up another one -- an elderly, frail man -- by the shoulders, slammed him against a mattress and barked, "I said, 'Stay in bed.' "

I agree with the length of time to be disciplined being maddening. For me it was a year and a half of sitting on pins and needles, wondering when I was going to get a phone call or something in the mail. One day I answered the doorbell and a woman was on my doorstep, an investigator from the Atty General's office. I talked to her, told her my side, and it was another few months before I finally heard from the BON. Then it was another 6 months before I received my "sentence" and was able to formally start my probation period.

I remember asking the investigator why it had taken so long to hear anything, and she said that I was considered low priority, because I hadn't harmed anyone. If I had harmed someone my license may have been suspended pending investigation, depending on the circumstances.

This is what I thought happened even now. I didn't realize until I read this article that the BON was so shorthanded it takes that long to investigate someone.

The thing that bothers me about the case listed is that he should have been arrested in addition to the BON report. That's assault and battery.

The patients we serve deserve more prompt response to these kinds of complaints!

It's unbelievable. This really scares me.

We had to attend a hearing while in school, and out of the 4 cases that went before the board, not one of them icluded someone on trial for direct pt care. There was one that had a inappropriate relationship with a mental health pt, but that was the closet to pt care related. The other 3 were an illigal drug charge, drug diversion and a dui charge.
