has anyone heard of a nurse losing a license due to being fired from a job due to breaking HIPPA?

We had a nurse in our organization that was fired for breaking HIPPA but was only warned by the NCBON...... To lose a license it must have been a purdy darn bad violation me thinks!!

I've heard of the organization and the nurse being fined, never loosing a license, but that doesn't mean it doesn't happen.

Definitely depends on the circumstances and if the former employer reported the violation to the BON.

Hmmm-It's HIPAA me thinks.

Health Insurance Portability Accountability Act?

and in my world, Occ Health, HIPAA is different. When someone gets injured we share some info to accomplish investigations, etc. They agree to it on employment. Nothing personal, mind you, but definitely about the injury itself.

Of course it's HIPAA, Glendah, appreciate you pointing that out as I was starting to hyperventilate ;)

And I wouldn't consider Occ Health to be any different than any other area of nursing....since your employees sign a relase of info as a condition of employment, it falls into that "covered communications" bucket....that area of the law gets a lot of quoting around here when providers attempt to deny us, the insurer, access to patient labs etc.

We have a nicely worded letter from our legal deparment reminding our contracted providers of their obligation to provide requested data on a member that we are managing.
